Below is Designki Graphic Design & Print standard Terms and Conditions. Please also note that from time to time DK may need to alter these terms and conditions without notice.

Please take time to read through our Terms and Conditions thoroughly and ensure you understand them before you commence a project with us. By requesting designs and/or printing service from Designki Graphic Design & Print (refer to as "DK") you (the client) agree to our Terms and Conditions and you are aware that you are entering a binding contract - payment is required.

Quotation
 

DK provides project estimates based on the information provided to us at the time of quoting. If work undertaken exceeds/evolves outside the scope of the orginal agreement, where ever possible the client will be notified of any additional fees.

Payment Terms
 

For Design Service 
For design project under $1000, full payment must be received before commencement of work. 50% deposit is required for project over $1000. 

 

In the case of a change of mind by the client after a project has commenced (once research, resources allocated or design work has commenced on a project), only partial payment will be refunded based upon the time spent.

For Printing Service
All printing accounts must be settled in full prior to the release of the files to the print. If you are having difficulty paying your invoice, please contact DK as soon as you are aware of the issue, so we can discuss a solution for this.

design samples
 

The client agrees to allow DK to showcase any/all work created in the course of a project as part of DK’s portfolio. DK acknowledges the confidential nature of projects and agrees to only display project work once product/site/event has been publicly launched/commenced/released.

force majeure
 

DK shall not be liable for any failure or delay in supply or delivery of products/services where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of DK including but not limited to war, natural disasters, strikes, lockouts, industrial disputes or unrest, government restrictions or transport delays, fire, power outages, failure attributable to hosting suppliers, breakdown of plant, theft, vandalism, riots, civil commotions, accidents of any kind or act of terrorism.

 

revisions
 

Each design package has a set number of revisions. If further revisions are required there may be additional charges applicable. The client will need to approve additional charges for extra design revisions and make payment in full prior to work commencing on the additional revisions.

 

excess work
 

This is defined as any work involving additions to the list of items defined in the estimate of services or changes to all pieces of finished artwork after sign off by the client. From time to time the client will require extra design requirements during a project, or extra files upon completion of a project. The client will be informed that the alterations or changes requested fall outside the original scope of work. Additional charges will be applied if the client wish to proceed. All additional costs will be added the original or new invoice created by DK, payable prior to delivery of all final files.

 

final artwork approval


Whilst every care will be taken, DK accepts no responsibility for errors (such as spelling mistakes, incorrect/missing information etc..) found after final artwork approved by the client. It is the client’s responsibility to proof read and approve all final artwork before production. Artwork approval must be sent electronically (via email, sms/text or through dropbox, facebook, instagram) to DK before commence printing. No refunds or reprints are given after a final approved design has gone to print due oversights by the client’s proof reading.

Printing will not commence until full payment for artwork and printing service is received. The current turnaround time for printing is 2-14 working days dependant on the project / product type. This period commences at date of client approval of artwork proof and payment. 

Colour Variations


With all printing there may be some colour variations from what you have seen on screen to what the final product looks like and previous orders. This is due to the nature of CMYK printing and bulk-run printing system. There will be no reprints at the expense of DK.

PRODUCTS & CONTENT

 

All DK content, products and prices depicted on this website are subject to change at anytime without notice. We make reasonable efforts to accurately display photos, images and descriptions of our products, including the applicable colours; however, the actual colour you see will depend on your display device and we cannot guarantee that your screen will accurately display such colours. 

INFORMATION ACCURACY

 

We try our best to ensure that information on this website is complete, accurate and current. Despite our efforts, the information on this website may occasionally be inaccurate, incomplete or out of date. For example, products included on the website may be unavailable, may have different attributes than those listed, or may actually carry a different price than that stated on the site. In addition, we may make changes in information about price and availability without notice. We will correct any pricing errors on the website as and when discovered.

Turnaround + Delivery


All turnaround time estimates are based on business days. No quoted printing, artwork or delivery dates are guaranteed and may vary for each individual project.

DK cannot be held liable for printing products that are damaged, lost or delayed when delivered by post or courier although the utmost care will be taken to ensure the products arrive on time and undamaged.

print returns & refunds


It is agreed that the DK is not responsible or held liable for any errors contained in the final product after the final product has been approved by client and produced by DK. DK will not be held responsible for and changes or amendment made after approval. It is the sole responsibility of the client to notify DK of any such errors during the revision cycle and before the final files have been generated.

In the event of a need to reprint due to errors in content, the client must inform DK within 3 business days of product acceptance, and must return the product (at the cost of the client) within 10 business days of acceptance for assessment.

Payment for re-printed project MUST be prepaid.

copyright


In accordance with the Australian Copyright Act (1968), copyright will remain property of DK until such time as a mutual agreement is in place. As part of DK’s terms of business, the copyright license is automatically released to the client on receipt of final payment for the commissioned work. DK reserves the right to use all artwork produced for the purposes of promoting DK in print, social media or website, unless explicitly denied to do so by client in writing. DK reserves the right to reuse any cancelled artwork for additional or subsequent projects. 

DK retains full ownership of design concepts and materials it produces. Once a final concept is delivered to a client and full payment is received, complete ownership rights to the concept transfer to the client. Unused concepts remain the property of DK. DK may still use paid-for concepts in its promotional materials and in its design portfolio. Unless the client requests otherwise, DK retains the right to display a small byline claiming design credit on works it produces, except for corporate stationery.

DK reserves the rights to certain elements used to create your projects including RAW files, fonts, patterns, stock images, textures, colour palettes and other non exclusive items.

 

DK reserves the right to use stock images in the creation of designs if required. Costs of this will be outlined to the client prior to purchase if not included in the proposal quote.

Submission of client artwork 


Clients who choose to submit their own artwork, files and/or images are solely responsible for the end result of printing. Customers are reminded to submit print-ready artwork with the correct specifications. We will print the Client’s submission as requested however DK is not responsible for artwork mistakes. DK is also not liable for supplied file errors. There will be no reprints at our expense. The client is responsible for supplying content free from infringement for all trademarks, service marks, and copyright.

artwork on disk or usb drive


If client’s artwork is requested on disk or USB, a fee of $30 applies. Courier/delivery cost will be payable by client.

termination policy


From time to time circumstances beyond the control of either party may result in the need for project cancellation. In the event of the client cancelling a project after a project has commenced, the advance payment (deposit) will be forfeited in lieu of compensation to DK. This is to cover design and administration time spent, resources purchased and allocated, research time and administration costs. If the project is more than 50% completed (this is determined by DK and the client by negotiation) a prorata payment is payable for time spent up until cancellation notice, at an hourly rate of $85 per hour plus GST.

If a project is cancelled by DK, due to unforseen circumstances, full refund will be provided to the client in a timely manner.

In the event of cancellation of the project by the client, ownership of all copyrights and the original artwork and disks shall be returned and retained by DK.

post-complection alterations


Other than for the promotional use of DK design, all services provided shall be for the exclusive use of the client’s said purposes only. Some designs may not be suitable to use for other promotional items. If adjustments required (after complection of project) for additional usage which was not outlined in the original project proposal, artwork alteration fee will be assessed as needed.
